If you bought shares in your name, you should not assume that you are allowed to dispose of them without taking into account the opinions of your half: if the marriage contract does not establish separate ownership of the registered securities purchased, then, according to the law, they will be considered joint property of the spouses. In a prenuptial agreement, one can define one’s responsibilities and rights by mutual content, ways of participating in each other’s incomes, and the procedure for each spouse to bear family expenses; determine the property that will be transferred to each of the spouses in case of divorce.
What should not be in a prenuptial agreement
Laws prohibit the marriage contract to limit the legal capacity or legal capacity of spouses. It is impossible, for example, to write in the contract that the wife does not have the right to work or accept an inheritance, or to establish enterprises. It is impossible in the contract to waive the right to appeal to the court for the protection of their violated rights. The Family Code establishes that the contract cannot regulate personal non-property relations between spouses, i.e. relations deprived of material content: choice of surname during marriage registration; choice of place of residence; the right to solve jointly all issues of family life; the right to divorce. The law traditionally regulates such relations in the most general way, confining itself to a statement of the equality of spouses in personal legal relations.
A prenuptial agreement cannot contain provisions regarding the rights and obligations of spouses in relation to children, including the determination of which of the parents the children remain in case of divorce. For this, there is an agreement on children. The contract cannot contain provisions restricting the right of the disabled spouse in need to receive maintenance - all these issues are regulated in detail by law.
